Passengers on Amtrak’s Northeast Regional Train 188 were delayed in their destinations, with some never arriving, when the train derailed on May 12, 2015.  Philadelphia and the surrounding area experienced chaos and devastation when the speeding train jumped the rails; flipping and crushing train cars.

Shock is replaced with accountability and blame by passengers with emotional and physical damages such as brain injuries, amputations, surgeries and even loss of a loved one.  Currently, 12 lawsuits have been filed against Amtrak and the train engineer within the federal court in Philadelphia.  Over 200 passengers and employees suffered critical injuries from the train accident and eight people lost their lives.  Personal injury and wrongful death lawsuits already filed include an employee with brain injuries from head trauma; a Swiss couple with severe and permanent injuries; and families of dead passengers.

Adding to the increasing number of lawsuits is a newlywed couple that was riding the Northeast Corridor (NEC) train that day.  Declan MacFarland suffered a concussion and Kathryn Varnum sustained multiple fractures in the derailment when their passenger car flipped onto its side.   Trauma from the train derailment extends beyond the physical and emotional damages and has had an impact on their future; MacFarland had a job interview scheduled and Varnum was meeting a client upon arrival in New York.

Amtrak and Train Engineer Accused of Negligence

Amtrak and the engineer are accused of negligence because the Philadelphia train accident could have been prevented if both parties acted responsibly.  Injured victims claim that the train engineer was reckless in the events leading to the derailment, and that Amtrak did not follow proper safety precautions because the Positive Train Control (PTC) system was not installed.   The PTC safety device is available and being used throughout the Northeast Corridor.

More than 2,200 trains operate on the Amtrak NEC rail everyday making it the busiest railroad in North America, according to Amtrak.   Passenger’s board trains every day in anticipation of their destinations without hesitation, unaware of the frequency of train accidents.  Train derailments result from colliding with other trains, hitting cars or trucks stuck on the tracks, and even striking pedestrians.  The Federal Railroad Administration notes that there have been an average of over 31 train derailments each year over the last decade.
