Philadelphia Construction Accident Lawyers: Insurance Fraud and Unsafe Working Conditions

So when the CEO of a construction company was brought to court during the last week of February for under-reporting the payroll of his employees, many in the industry were shocked. However, what may really anger workers is the accusation by the New York City (NYC) district attorney that the CEO’s “lax approach to following proper procedures may be characteristic of a much more dangerous disregard for workers’ safety.” The NYC district attorney went on to say that dishonest business practices get in the way of safety oversite and could create extremely dangerous hazards to construction workers and residents of the city.

The NYC district attorney has a lot of evidence to back up his statements. In 1997, the CEO was charged criminally when he was allegedly a part of a bribery scheme that revolved around stolen construction trucks that were located in a landfill. In addition, the CEO’s current indictment came about after local officials investigated the death of a 22-year-old who was killed on one of the CEO’s construction sites in April of 2015. The young worker was killed when he was crushed by a trench that collapsed because it was improperly secured and the company was fined by OSHA.

In a separate charge related to the same incident, the CEO was charged with criminally negligent homicide and reckless endangerment because he failed to notify the now-deceased worker in the correct language that he was in danger and needed to get out of the pit before he was killed. Finally, the company’s foreman and a supervisor were formerly charged before with manslaughter because they refused to shut down a site on Ninth Avenue against the advice of an engineer who warned them of the impending danger to the worker.

After his indictment, the CEO is now facing charges in New York of first degree Workers’ Compensation insurance fraud and filing false statements.
